The Village of Oswego welcomes food trucks and established guidelines for food trucks in 2016. In early 2020, some regulations regarding food trucks on private property were relaxed to allow residents and businesses to host events without unnecessary red tape. The following regulations are designed to ensure that food truck operators, businesses, and individuals who want to host a food truck operate safely for patrons. 

Rules for food trucks are slightly different depending on whether the food truck sets up on public or private property. 

Private Property

Food trucks are welcome to operate on both commercial and residential private property in Oswego with the consent of the property owner. 

  • If a food truck is on private property and selling only to a private event or party, you do not need a Kendall County Health Department food permit specifically. In these instances, the food truck is treated like a caterer and needs a food permit from a county in Illinois to operate, but it does not need to be a Kendall County food permit.
  • No license from the Village of Oswego is required for food trucks selling on private property.
  • There are no restrictions on what times a food truck can sell on private property.
  • Food trucks must have permission from the property owner.

Public Property 

Food trucks are also welcome to sell on public property, with the following restrictions:

  • All food trucks selling on public property must also have a Village of Oswego license.  Applying for a license requires a background check, a $200 application fee that includes one food truck, and a $40 background check fee for each operator of the food truck. The license is good for one year. Apply for a Village of Oswego Food Truck license. 
  • Food trucks on public property are allowed to sell from 6 a.m. to 8:30 p.m. every day. 

Safety considerations 

Regardless of whether the food truck is located on public or private property, the following rules apply:

  • Food trucks may not operate in any area where the operation impedes vehicular or pedestrian travel. The Village will restrict locations if a particular location creates a parking shortage, parking issue, or unsafe parking conditions.    
  • Food trucks on streets must set up facing the curb so that patrons order from the parkway, not the street. 
  • Food trucks are prohibited:
    • On Main Street, from Jefferson Street to Tyler Street
    • On Washington Street from Parkers Mill to Route 71
    • Within 200 feet of any school property between 7 a.m. and 4 p.m. or when school is in session, unless the mobile food vendor possesses written permission from the school district that contains a date and time range that they are authorized to operate as a mobile food vendor on school district property
    • In any park, or on park district property unless the vendor has permission from the Oswegoland Park District.
